For Galapagos Renaissance you are a very valuable customer and we hope to have you as our special guest on one of our expeditions. This page is designed to inform you about the terms, conditions and our policies that govern your participation in our Galapagos cruises, and / or Ecuador Mainland Journeys, in this way you will be able to enjoy a safe and once-in-a-lifetime trip.

Galapagos Renaissance strongly advises to read this agreement thoroughly and carefully before booking a tour with us as it contains important terms and conditions regarding the tour you are purchasing including, but not limited to, our rights to alter the tour, our cancellation and refund policies, and a limitation of our liability and other important disclaimers. By paying your deposit to book a Galapagos Renaissance Journey, a contractual relationship is established between you and Galapagos Renaissance, in which all Galapagos Renaissance terms and conditions apply.

The policies described in this document, in combination with your completed, dated and signed Passenger Information Form (s) along with your invoice and other applicable documents mentioned below, constitute the complete and mutual Agreement that governs the relationship between GALAPAGOS RENAISSANCE GRN. CIA. LTDA, company regulated under the laws of Ecuador, located at Vasco de Contreras N35-76 and Hernández de Girón, Quito – Ecuador, hereinafter referred to as “Galapagos Renaissance” and you, hereinafter referred to as “passenger”, “customer”, “guest”, “client”, or “participant”.

The Client, will adhere to the following confirmation and cancelation policies:

Fit Reservations

  • The payment of 10% of the total invoice must be paid at the time of confirming the spaces; this amount must be paid up to a maximum of seven (7) days after the date of confirmation of the spaces, otherwise GALAPAGOS RENAISSANCE reserves the right to cancel the tentative confirmed reservation.
  • The balance of 90% of the total of the invoice must be paid 60 days before the cruise departure date, otherwise GALAPAGOS RENAISSANCE reserves the right to cancel the previously confirmed spaces.

Charter Reservations

  • The payment of 10% of the total invoice must be paid at the time of confirming the spaces; this amount must be paid up to a maximum of seven (7) days after the date of confirmation of the spaces, otherwise GALAPAGOS RENAISSANCE reserves the right to cancel the tentative confirmed reservation.
  • A second payment of 20% must be paid 120 days before the cruise departure date, in case the payment is not made according to the established policies, GALAPAGOS RENAISSANCE reserves the right to cancel the previously confirmed spaces.
  • The balance of 90% of the total invoice must be paid 60 days before the departure date of the cruise, in case the payment is not made according to the established policies, GALAPAGOS RENAISSANCE reserves the right to cancel the previously confirmed spaces.

The following cancellation policies will apply regardless of circumstances:

Fit Reservations

  • The initial 10% deposit is not refundable under any circumstances.
  • If the cancellation of spaces is made 60 days (or less) before the cruise departure, 100% cancellation charges will apply.

Charter Reservations
When making a charter reservation the client understands that it involves a serious financial commitment for which the Charterer assumes all responsibility and risk and is in no reason or circumstance exempt from the charter cancellation policies.

  • The initial 10% deposit is not refundable under any circumstances.
  • If the cancellation of spaces is made between 120 and 61 days before the date of departure of the cruise, 30% of the total of the invoice will be applied as cancellation charges.
  • If the cancellation of spaces is made 60 days (or less) before the cruise departure, 100% cancellation charges will apply.

Failure to comply with any of the above requirements entitles Galapagos Renaissance to cancel the reservation and retain the corresponding values of payments received in accordance with the established policies. The payment of the deposit or any payment for a reservation will constitute consent to all the provisions contained herein. With this, the client understands and accepts all the provisions without restriction, including their consequences, contained in the Galapagos Renaissance Terms and Conditions.

During all Galapagos Renaissance Journeys, all Passengers / Clients shall follow the following conditions:

  • Most Galapagos Renaissance Journeys take place within and under the auspices of the Galapagos National Park, which stipulates that without exception all its rules and regulations must be followed by all park visitors at all times, whose responsibility it is to know and adhere to the Galapagos National Park rules and regulations that are informed by the Galapagos National Park Guide that led all Journeys. The Galapagos National Park and Galapagos Renaissance, through the authority of the Galapagos National Park Guide, reserves the right to deny any visitor, in violation or disregard of the Galapagos National Park rules, the ability to disembark upon or visit any Galapagos National Park landing site. Such violation may cause a passenger to be disembarked at the nearest port of call that offers transportation from the islands back to the Ecuador mainland without recourse to refund.
  • In addition to obeying the Galapagos National Park Rules, Passengers have a responsibility to Galapagos Renaissance, its crew members and other passengers as well as the Galapagos National Park Guides. Passengers are responsible for comprehending the Journey conditions communicated to them in the trip itinerary, as well as information communicated by guides and crew members throughout the cruise Journey. Passengers should follow normal patterns of social behavior, not to impede Journey operations, and should follow all safety requirements without exception, while acting in a respectful manner toward crew members and all personnel staff that supports any Journey service. Galapagos Renaissance, reserves the right to disembark or refuse passage to any Passenger at any time without recourse to refund or reimbursement, who is believed to be dangerous to himself or acts in a hostile and/or disruptive manner, whose actions impede Journey operation or the enjoyment of other passengers.
  • Galapagos Renaissance aim is to ensure safety to each passenger that it accepts on its Journeys is properly capable of participating in the cruise or land Journey so as not to jeopardize their own safety or the safety of other passengers and crew members, so Passengers have the responsibility to select a Journey appropriate to their abilities. Galapagos Renaissance will not pay for any costs resulting from the inability to do so. Passengers need to be in good health and good physical condition to be able to fully enjoy a Journey to the Galapagos Islands and Ecuador mainland. Passengers also understand that experiencing the Galapagos islands will involve frequent transfers ashore to landing & snorkeling sites, aboard small boats (pangas), requiring some physical effort and balance; some landings may be on some wet stones, slippery lava rocks, while other may take place on sandy beaches with some sea waves. Daily hikes may also include walking on irregular and elevated terrain including boulders. Travelling through Ecuador highlands may involve experiencing altitudes between 2.500 and 3.500 meters (8.220 and 11.500 ft) above sea level. If a Passenger suffers from any medical condition that might impact their travel experience they should review with their physician before participating in a Galapagos Renaissance Journey in order to ensure they are fully capable of undertaking the trip, also Passengers must advice Galapagos Renaissance of their medical condition and any associated medical needs at least 45 days prior to travel once they have been given the medical go ahead by their doctor. Galapagos Renaissance reserves the right to not accept passengers on its Journeys based on medical health issues.
  • Galapagos Renaissance strongly urges Passengers to purchase a travel insurance Policy that includes any trip cancellation, interruption coverage and baggage loss protection. Travel Insurance should include medical coverage and coverage for emergency evacuation; Passengers not having this coverage will be required to cover their own medical evacuation costs under all circumstances.
  • Galapagos Renaissance, in conjunction with international law, the laws of Ecuador and the rules of the Galapagos National Park, prohibit passengers from carrying, either upon their person or in their baggage, any object or material of any nature that may be considered dangerous to the security of other passengers, the crew, travelers, the motor catamaran or the general public, including but not limited to explosives, weapons of any kind including those used for sports and inflammable objects while participating on any Galapagos Renaissance Journeys.
  • The Passenger’s baggage, including all his/her belongings, is under his/her sole and exclusive care and responsibility. The client accepts that Galapagos Renaissance shall have no liability for loss or damage howsoever caused, even if by the negligence of the company.
  • Galapagos Renaissance urges to protect the Galapagos National Park from introduced species so is strictly forbidden for visitors from transporting biological items, including but not limited to flowers, plants and seeds grown elsewhere, into the Galapagos National Park. Passengers should not attempt to bring items such as roses or tropical flowers purchased in Ecuador mainland to the Galapagos as these will be confiscated and the offender fined.
  • Galapagos Renaissance expressly forbidden the transport or use of any illegal substance, including illicit drugs. Penalties are severe in Ecuador for the discovery of illegal drugs and controlled substances on board a vessel in the Galapagos Islands, in the vehicle during land transportation in Galapagos and Ecuador mainland, or in the luggage at airports. If such substances are used by, or found to be in possession of any Passenger , they will be put ashore at the next port of call without refund and be subject to arrest and prosecution under the law. The possession of even minor amounts of any illegal substance can lead to charges of trafficking in Ecuador.
  • Galapagos Renaissance accepts children as passengers, although children are under the sole responsibility of their parents or legal guardians; Galapagos Renaissance refuses all and every liability for any accident that might occur to minors.
  • Galapagos Renaissance may take photographic or film recordings of the cruise or land Journey and its participants, and may use such records for promotional and/or commercial purposes.
  • Galapagos Renaissance offers a varied menu of local and international cuisine designed to accommodate a variety of dietary needs, Passengers with special dietary requirements are asked to specify their dietary needs at least 30 days prior the departure date. Those general and specific dietary needs not clearly conveyed to Galapagos Renaissance cannot be met. Galapagos Renaissance will make every reasonable effort to cater such requests within reason, subject to availability of products in Ecuador though Galapagos Renaissance retains the right to refuse to cater for such requests.
  • Passengers participation in water sports including, snorkeling, kayaking, paddle boarding, diving, etc. is done at the discretion of the Passenger who assumes all inherent risk.
  • Galapagos Renaissance does not allow the use of motorized or naturally powered equipment by passengers during its expeditions. This includes the use of unmanned aerial vehicles (drones), radio-controlled surface and underwater vehicles, kites, and all types of equipment that could result in contamination of the Galapagos environment or harm to its wildlife.
  • Gratuities to recognize excellent service are a personal matter and are entirely at the discretion of the passenger.

The Client undertakes to make all payments via bank transfer, certified check or bank deposit to Galapagos Renaissance bank account. All transactions must be in US dollars and any expenses for transferring the funds must be covered by The Client and included in payments made. All payments indicated above must be received, credited and cleared in Galapagos Renaissance bank account by the specified due date or the reservation may be released and deposits forfeited. Galapagos Renaissance reserves the right to refuse name changes on bookings as to issue final confirmation Galapagos Renaissance requires Passengers complete names, passport numbers and copies, nationality, date of birth, marital status, as well as dietary and medical requirements.

Payment through credit card has a surcharge according to supplier policies.

No refund will be given for cancellations due to cancelled, delayed or missed flights. Galapagos Renaissance strongly recommends Passengers to obtain trip cancellation insurance to better protect themselves, such insurance should also have coverage for medical evacuation.

If a Journey is purchased from Galapagos Renaissance in the name of a third party/person to be the beneficiary that party/person is also bound to all statements and conditions contained herein.

All current and additional taxes and surcharges not explicitly mentioned in this document may also change according to the rules, regulations, legislation and the discretion of the National Parks and local government. Galapagos Renaissance reserves the right to modify rates or introduce surcharges, even when payment has already been received in full.

Galapagos Renaissance is not responsible for any expenses incurred by the passenger or passenger’s booking agents in preparing for the Journey, including non-refundable or penalty- carrying airline tickets, special clothing, visa or passport fees or other voyage related expenses. A tight time-schedule connection with a Galapagos cruise is unwise, Galapagos Renaissance strongly suggests that a flexible air ticket be held for your journey home.

All Passengers taking part in a Galapagos Renaissance Journey do so at their own risk and in full knowledge that their Journey to the Galapagos Islands and Ecuador mainland involves risks and dangers including but not limited to, the forces of nature, the unpredictable behaivor of wild animals, civil unrest, terrorism, roads, trails, hotels, travel by vehicles including taxis, buses, airplanes and ocean going vessels, exposure to high altitude, the consumption of alcoholic beverages, physical exertion for which the participant may not be prepared and or negligence on the part of Galapagos Renaissance, or others, and during the Journey Passengers may be exposed to adittional risks and hazards including but not limited to the possibility of accident, injury or illness in a remote area without acess to emergency care, rapid evacuation, adequate medical facilities or availability of medical supplies.

All Passengers acknowledges that the enjoyment derived from a Journey and expedition comes in part from the inherent risks incurred when travelling, including exposure to activities offered during the Journey such as, but not limited to, swimming, kayaking, hiking, snorkeling, horseback riding, scuba diving, which are enjoyed with the Passenger´s voluntary participation.
Fully understanding the risks and that the cost of a Galapagos Renaissance Journey is based upon Passenger fully accepting the conditions stated and implied herein , Passenger agree to be responsible for their own welfare, and accept any and all risks of delay, unanticipated events, death, illness, injury or emotional trauma and acknowledge that they are voluntarily participating on the trip in full knowledge of these risks and therefore discharge Galapagos Renaissance and its Galapagos Renaissance agents, contractors, affiliates, and employees from an against any and all liability arising from their participation in the Journey or expedition. Journey participants further agree that this release shall be legally binding upon themselves and all minors under the age of 21 travelling with them, their heirs, successors, assigns and legal representatives, it being their intention to fully assume all the risk of travel and release Galapagos Renaissance from any an all liabilities to the maximum extent permitted by law.

Galapagos Renaissance including its agents, employees, contractors, guides, affiliates, directors, officers and shareholders hereinafter referred to Galapagos Renaissance, gives notice that some of the services it provides, including transportation, hotel accommodations, restaurants and other services are often purchased from various independent suppliers not always affiliated with Galapagos Renaissance. While Galapagos Renaissance will always seeks to work with the most appropriate suppliers available, Galapagos Renaissance has only limited ability to control the operations of these providers, therefore, Passengers arranging Journeys through Galapagos Renaissance do so upon the express condition that Galapagos Renaissance shall not be liable for any delay, cancelation, mishap, inconvenience, expense, irregularity, bodily injury or death to a person or damage to property, occasioned through the conduct of default of any company, individual or other party engaged in providing this services. Each of these suppliers is subject to the laws of Ecuador and their liability may be limited by their tariffs, conditions of carriage, tickets, vouchers, international conventions and agreements.

Client release Galapagos Renaissance from any and all claims of loss or damage to baggage or property, for personal injuries or death, for loss or delay arising out of the act, omission or negligence of any independent contractors or third party supplier such as air carriers, cruise lines, hotel restaurants, transportation providers and other service or facilities. Galapagos Renaissance is not responsible for incidents such as airline cancelations, re-routing or any disruptions of schedule, service or accommodation.

Any controversy or difference derived from this contract will be resolved with the assistance of a mediator from the Arbitration and Mediation Center of the Quito Chamber of Commerce. If the mediation procedure does not give a favorable result for any of the parties within a period of ten calendar days from the beginning, this period may be extended by mutual Agreement for an equal period, then the parties renounce jurisdiction and domicile, and agree to submit controversies to the resolution of an Arbitration Court that will be subject to the provisions of the Arbitration and Mediation Law, the Regulations of the Arbitration and Mediation Center of the Quito Chamber of Commerce.
